Hi Guys,

I'm renting room in one of the condo since 2009.

i had car back in 2011 and management allowed to park the car. I'm planning to buy a car now and when I applied to park my car, management rejected and saying by law, tenants cant park the car. surprisingly owner don't have car as their in overseas and there are lot of empty car park slots.

any advise?

You didn't ask your landlord to apply?

Odd it may seems, a few condos I know have this rule. Tenants can only park in open car park. There is no law, it's their own law

Ask your landlord to get the clearance...

landlord just emailed to management. I'm ok if they allow me to park in open car park. their law is completed cant park inside condo regardless covered or open car park.

don't get the landlord to ask the management. just make the LL apply it for you as if your car was their own.

draw up paperwork to support it if necessary (eg, you have rented your car out to your LL...).

As you are renting a room, have the other co-tenants cars? Most condos limit the no of parking lots per unit (what makes sense). If you just rent a room, the situation is IMHO more tricky and if your LL doesn't cooperate (luckily, looks he does) means to convince him are going to be limited.

It's the local LLs mentality.

This situation depends entirely on the MC by laws and policies. In our case (I'm on the MC) we allow only the OCCUPIERS of the unit to park. If a tenant has a TA agreement he gets the spot; not the non resident LL. In our case the car park is not part of the strata property title but common property and we can do that. What we found before we did this is that non resident landlords where filling up our spots with cars belonging to their relatives and friend and whatever. In OP case it seems the MC has sided with the property owners. I recommend all renters clarify this in negotiation and insert a clause into the TA covering parking.

@ taxico - seems renting car during weekdays its illegal (based on LTA guidelines).
@ x9200 - no one has the car in our unit including LL. LL sent email to management. MC reply negative
@ PNGMK - understand some misuse the facilities. but i dont think restrict tenants not to park has point while no one own car in this unit. And I'm staying here since 2009. Sick of it. may be time to move out from here.

They stated in their by-law "only vehicles owned by residents and their guests may be parked overnight"

You are a resident you moron. You have a TA and therefore you are a resident. That's exactly what our MC expects. Go to the MA with your TA and car details and insist they register the car as a residents car.

I was thinking same way. but for MC, residents and tenants are different. very weird.

It's not weird if you ever had opportunity to talk a bit more to a local LL. Many of them basically think they are lords and they do you a favour renting you the property. They think they have full right just to enter, to check the mailbox etc. etc.

PNGMK, good advice to include the car relevant clause to the TA. I believe without the inclusion it would also work (I would demand lowering the rent if I rented out the whole unit and couldn't get a lot) but having it in TA makes it explicit.

Many years ago when I was an impoverished renter I always asked before signing if I had a car spot. That seemed to be enough but I know believe some landlords are renting out their car park spaces in more desirable locations and the MC are permitting this to happen.

Car park lots are just part of the facility so IMHO if something is not available the LL should inform the tenant about it before signing TA. It is like one rents a condo apartment and all the sudden discovers he rented a bare flat with the right to access it. This is not a common practice and not a common understanding so it is actually in the best interest of the LL to ensure the facilities are available or the tenant is fine, if they are not.

Gave up buying car and cancelled all arrangement.

I will move out from this condo. Can't tolerate their by-law (favour to them as it managed by unit owners here). I felt they dont like LLs to rent to tenants.

In Australia most strata titles define the car park situation. In Singapore I don't believe they commonly do. So actually the MC has control of the car park, not the LL. That's where the issue is arising I think. A landlord does not own or have assigned slots many times.
