Diplomatic Clause-35 Months

Tenancy Agreement-Diplomatic Clause
My wife and I have been tenants for 3 years at the same apartment. A two-year contract then a 12-month extension. My wife's company is relocating us to Sydney and we need to be there one month before our tenancy lease expires. We have used the Diplomatic clause (and found several people who want to rent when we leave) but our landlord is saying we can not invoke the DC as the 1-year extension is not part of the 3 years.
Is he correct even though we have lived here for 35 months.

Yes I would be believe so that the owner might be right. The 2 years would come with the usual 12+2 months diplomatic clause for that 2 years. Subsequent would be a full year without diplomatic clause, unless your renewal states so. You might need to check on ur renewal terms.
