Singapore Expats

Hi guys,

I've created a Partnership with a friend like year ago. Everything is going well but I have few doubts and questions bout Employment passes. As you may know, the ACRA takes forever to provide with and answer and the phone line never responds.

Both partners, we are foreigners. We actually hold and employment pass since we both have been working here. The idea of the partnership came afterwards.

My questions are:

- If two person have created a partnership and they are both working with an EP sponsored from their corresponding companies (No the Partnership company). Is there a way, any of them can apply for an EP in case this person decides to work full time for the partnership or has been fired from the company he used to work for?

- One of the two partners has decided to leave SG. What will happen to the Partnership if the second leaves SG too?


- What are procedures to do proceed with those scenrarios?

Are you talking about a limited liability partnership (LLC) or a partnership operating as a business.

PS: It is MOM you need to talk to about work permits, not ACRA.

In general, though, you will probably have a hard time convincing MOM that your partnership is a legitimate source of employment. Look at it this way: Somebody on EP loses their job. They run over to ACRA and start a LLC or company. They apply for EP to work for the company to stay in Singapore. They have no clients, no revenue, no contracts. MOM is wise to this stuff.

IF you have employees in this partnership and IF the partnership is earning a profit sufficient to support all partners, then maybe you will be approved for an EP. But again, it depends on the particulars... if you pay yourself S$8000 and get a P1 chances are better than if you indicate a S$3000 salary.

It makes sense. Then I should talk to MOM rather than ACRA. Gotccha
