Terms and Conditions of Use - PROPERTY
SingaporeExpats.com Pte Ltd (“the Company”) provides a compilation of properties
for sale or rent in Singapore (“the Compilation”) and a Property Classifieds
service comprising of a (i) property search engine; (ii) property classifieds
posting service; (iii) property pictures and (iv) Condo directory. The Company
does not carry out any estate agency work in respect of the properties in the
Compilation.
Interpretation
Throughout this agreement, the term “Vendor” shall be taken to mean any
provider, supplier, or individual in control of the relevant property.
Copyright, Trademark and other Proprietary laws
All materials on this website including editorial contents, graphics, pictures,
scripts, data, logos, icons and codes are protected by Singapore copyright,
trademark, patents, and other propriety laws and may not be copied compiled,
arranged, reproduced, distributed, transmitted, displayed, published, printed,
or broadcasted without prior written permission of The Company or in the case of
third party owned materials, the owner of that content. To exploit such
materials would violate such copyright, trademarks, patents and other
proprietary laws. You may not alter or remove any trademark, copyright, or other
notice from copies of the content.
The website has been specially designed and compiled for the presentation of
content in a unique format and appearance to The Company’s users. The
compilation (meaning the collection, arrangement and assembly) of all content on
the website is the exclusive property of The Company and is protected by
Singapore copyright and other proprietary laws. All software used on the website
is the property of The Company or its software suppliers and protected by
Singapore copyright and other proprietary laws. The Company is concerned about
the integrity of the website when it is viewed in a setting created by a third
party that includes advertising or other materials that The Company has not
authorized to be displayed with the website. Without limiting the foregoing
provisions, neither you nor any third party shall make use of the contents of
the website in any manner that constitutes an infringement of The Company’s
legal rights, including copyright.
You shall use your best efforts to preserve and protect the integrity of the
content and you shall forthwith notify The Company of any infringement, whether
actual or apparent, real or perceived, whenever occurring or determined, of such
content and render all reasonable assistance to The Company in the enforcement
of its rights.
The Company will not hesitate to prosecute any violation of any of its rights in
the content and/or the services to the maximum extent permissible by the
applicable law.
Subject to the terms and conditions laid out here, website visitors are granted
a limited, non-exclusive and non-transferable license to use the software and
documentation necessary for the use and enjoyment of this website and its search
engine services. Except for the above, no other license shall be implied from
the website content without the prior written permission of The Company or any
other such third parties that may own the rights to the relevant content.

Unless expressly authorized by The Company, this website is strictly for your
personal and non-commercial use. You may, to the extent that this website
expressly authorizes you to do so, download and print one copy of the website
content onto a single computer for personal, internal and non-commercial use. No
such proprietary rights or interests in the content are transferred to you when
you download or print such material.
Relationship Between You and The Company
The relationship between you and The Company is that of independent contractors
dealing at arm’s length. You acknowledge that there is no fiduciary, agency,
employment, partnership or joint venture relationship between you and The

Using the Property Classifieds service
Should you choose to post your property on the Property Classifieds, you
hereby do and shall grant The Company a worldwide, non-exclusive, perpetual,
irrevocable, royalty-free, fully-paid, sub-licensable and transferable license
to use, reproduce, modify, distribute, prepare derivative works of, display,
perform and otherwise fully exploit the content posted in connection with our
website, the services provided on it and any other aspects of the Company’s
business (including the business of its successors and assignees). This license
granted above are all purely non-exclusive and do not affect your other
ownership or license rights in your property content, including, but not limited
to your right to grant additional licenses to such content.
You represent and warrant that all content posted by you is your original work
of authorship or that you otherwise control all rights to the content posted and
that disclosure of these posts by The Company (including, without limitation,
publishing them on SingaporeExpats.com) will not infringe or violate the
intellectual property or other rights of any third party. You agree to notify
The Company of any acts or circumstances of which you become aware that would
make this representation inaccurate in any respect.
You will be required to provide The Company with certain personal details before
you are able to post your property on the Property Classifieds. The Company
takes your privacy very seriously and will not divulge your personal information
to third parties without your explicit provision, or unless as set out in its
Privacy Policy.
Warranty Disclaimer
The Company strives to ensure that the contents on this website are accurate,
current and reliable. However, the Company (including its officers, directors
and employees) is not infallible and sometimes errors/omissions may occur.
Therefore, The Company cannot, and does not, guarantee the correctness,
precision, thoroughness or completeness of any of the information available on
this website, nor will it be liable for any inaccuracy or omission concerning
any of the content or information provided on this website.
Most of the information or graphics involving the properties on this service
will be provided by the property Vendors themselves who are solely responsible
for the accuracy and reliability of such content. The Company makes no warranty
or representation as to the accuracy and reliability of such content and
expressly disclaims all liability or responsibility with regards to such
content.
The Property listing service is provided on an “as is” basis, and is without
warranty of any kind , express or implied, including, but not limited to the
implied warranties of title, non-infringement, merchantability and fitness for a
particular purpose, any warranties implied by any course of performance or usage
of trade, and those arising by statute. The Company hereby disclaims all such
warranties, express or implied.
The Company does not warrant that the website and/or its services will be
timely, secure, uninterrupted or error free. The Company also makes no warranty
that this website will meet your expectations or requirements.
The Company does not make any warranties (express or implied), including, but
not limited to, any implied warranties of merchantability or fitness for a
particular purpose, or any warranties as to the frequency of usage and traffic
of the website, or the performance, functionality or processing time of this
website.
The Company also assumes no responsibility or liability for any damages to, or
viruses that may infect your computer equipment on account of your access to, or
browsing of the website, or your downloading of any content, material or
software from the website. Your use of the services is ultimately at your own
risk. If you are discontented with this website and its services, your only
remedy is to discontinue using the website.

Indemnification
You agree to indemnify the Company for any loss, potential loss, claims, costs,
expenses or other demands resulting from any claims, causes of actions, suits,
proceedings brought against it which have arisen from your use of this property
listing service or form any of your breaches of these terms and conditions.
Relief
In the event that you have a dispute with one or more users, you release The
Company from all claims, demands and damages (actual and consequential) of every
kind and nature, known and unknown, suspected and unsuspected, disclosed and
undisclosed, arising out of or in any way connected with such disputes.
Limitation of Liability
In no event shall The Company be liable for any:
(i) Damage to or virus that may infect your computer that resulted from your use
of this website and/or its services;
(ii) injury, loss, claim, damage (including special, exemplary, punitive,
indirect, incidental or consequential damages) of any kind due to the use of
this website and its contents; any omission or delay in the use of it; and the
performance or non-performance by The Company. It is irrelevant whether the
claim is based in contract, tort, strict liability or otherwise, there shall be
no liability in any event;
(iii) loss that may result directly or indirectly from any act of God or nature,
or any other causes which are beyond The Company’s control.
Despite the above, if The Company should be found liable for any damages or loss
that has arisen from the use of this website, the liability of The Company shall
in no event exceed SGD 500.
Termination
We reserve the right to terminate this agreement at any time in our sole
discretion. Such termination shall not affect any right that The Company may be
entitled to. However, all rights granted to you shall be extinguished and revert
back to The Company upon such termination.
Severability
These terms and conditions shall be deemed severable. Even if a term or
condition is deemed illegal, invalid or unenforceable, all remaining provisions
in this contract shall remain in full force and effect.
Governing Law
The governing law over these terms and conditions and their enforcement shall be
the laws of Singapore, without regard to conflict of laws. All issues and
questions resulting from your use of this website and its terms and conditions
shall now be submitted to the sole and exclusive jurisdiction of the Courts of
Singapore. You are not authorized to use this website in a jurisdiction that
does not give affect to these terms and conditions, including, without
limitation, this paragraph.
