Hi

I need to know abt some legal matters regarding separation.

My (worse) half had/ is having an extra-marital affair aftr 15 yrs of marriage. v hv 2 kids. One day he just took all his stuff n walked out. V married in India. Aftr many arguments he now gives some money for our daily expenses.

I was working earlier but by mutual agreement decided to become a stay-at-home mom. Now aftr a gap of so many years it is not easy to get a job.

What i want to know is is HE not bound by law to pay for the up-keep of our maintenence ? Can he pay only the amt he wishes to and not what we normally used for the daily expenses ?

What abt the responsibilities of a "father" ? He has run away frm everything and is just enjoying life.

Can anyone give any sensible soln to this issue please ?

He has become a citizen. Me n kids are PR. When PR expires what happens to us ?

Well, i suggest you should contact a good lawyer and if you think you can't afford the fees.. you could contact any female social networks..like AWARE. They can help you with your case.

Well, I am not a lawyer however have considerable experience of these things - since I have been running an NGO on conflict resolution in India. If I can help please let me know.

I hope you had some luck with AWARE. You can also go to the Meet the People Session where you can get free legal advice. You can check it out from People's Association Website. It's usually held at the Community Centres and you need to call to get appt first.
You can call Immigration and find out info from the Family Court website. The maintenance part should be ordered by the Court. Hope it's useful info.

If you have your husbands passport and NRIC file for citizenship using his particulars included in the application form.

It is legitimate because,
- You are PR
- You are legally married to a citizen

Go for it. Become a citizen and represent yourself in court, am not sure you need a lawyer.

Get testaments from people who can vouch for you living alone and if you know his new address the court can get documentary proof that he was staying separately.
